Our client was charged with assaulting a police officer, an offence that carried a mandatory six-month jail sentence. Tim Hampson from our office spent several months negotiating with the prosecution, right up until the day of trial.
On the morning of the trial, Mr Hampson successfully convinced the prosecution to downgrade the charge, thus avoiding the mandatory jail sentence. With the removal of the mandatory jail penalty, we were able to present submissions to the Magistrate, requesting a fine and a spent conviction.
The Magistrate imposed a small fine and granted a spent conviction. This outcome was a great result, especially for a client who had been mentally prepared for prison that day, only to leave court with a far more favourable resolution.
The client left the following testimonial: “Tim Hampson is an incredible lawyer. I was facing mandatory imprisonment, but Tim negotiated tirelessly for the last four months to have my charges reduced. Despite the prosecution repeatedly stating they wouldn’t change the charge, Tim never gave up—even negotiating over the weekends. Today, my charge was downgraded, and I received only a fine. For the past 10 months, I’ve been stressed and unable to sleep. Tim believed in me and saw I was a good person. I can’t thank him enough. The best.”
